if i took an old case back to court, can i get sentenced for the same crime in which i already served ?Taken old case to clear my good name from a criminal record?
No. If you were convicted or pled guilty and served whatever sentence was handed down, then the case has been disposed.
If you wish to reopen the case because you have evidence, and I mean completely solid evidence that exonerates you, then you should speak to the District Attorney's office or the Attorney General's office (depending upon which office prosecuted you originally) and explain to them what you desire and why they should re-open this old case.
If this fails because you get the run around, then you should be prepared to take your case into the court of public opinion via the press or television news. Once again, if you do not have absolutely compelling evidence to support your contention, then you will make no headway.
Finally, if there is any possibility that you could be charged with an accessory crime for which the staute of limitations has not run out, then you had better seek legal counsel before doing anything more in this regard. I am not suggesting that you committed any such accessory crime, but if one exists and a person is out there who might offer some testimony that you committed the accessory crime in exchange for leniency in another matter, then I suspect that is what will happen to you.
If you are innocent of this charge, then I wish you luck restoring your good name.
