I live in the UK @ the age of 15 I was arrested by two police officers who had falsely claimed that i was trying to open a car to steal it even though i had not learnt how to drive until i was 22. i have never been in trouble with the police and i was in the Air Cadets i wanted to become a pilot that stopped me form joining the RAF at 16 .They lied in several courts as i fought them all the way i was found guilty and was told to promise to behave for 3years or i would be sent to Borstal. i dnt want to do either but I had no choice i paid the fine . Anway im in my forties now and a few years ago i was driving my car and was stopped by the police and was checked they reported back i was not wanted but i was on their system .
How can I clear my name this record has surley affected my job appilcations over the yearsHow can I clear my record ?
You are always going to have the stigma of ';known but not wanted'; as you were convicted of a crime no matter what the mitigating circumstances. Under the Rehabilitation of Offenders Act you can truthfully put the answer No to the question ';Have you ever been convicted of a criminal offence?'; unless the position you are applying for is exempt from the Act.How can I clear my record ?
Im sorry.Its permanent.
Even more interesting,Any contact with the police where you are a suspect but not even arrested before you are released without charge is also kept on record forever, but will not form part of your criminal record.
However, all arrests, followed by release without charge, will be visible on your record.
The best advice is ,blatantly lie on your job application. In the real world ,it is very rare that you will get an employer who admires you for your forthrightness against the risks he takes on by hiring a ';criminal';.In some situations, your employer will be bound by duty to refuse you.
I don't think you can.
I think employers can only have access (with your permission) to those crimes that are still current. Meaning those where you are still under probation or, in your case, serving a three year caution.
Short answer is that you cannot. Once you are on the police records for even a minor offence that's where you stay until death. The good news is that your offence is now probably SPENT, so there is no need to mention it on forms etc even when asked. Only exceptions is for certain jobs like security or working with children. Try top forget it and get on with the rest of your life. Best of luck.
By the way ask a solicitor or some other person that knows the law about spent records.
